Terms and conditions of performance contract.

These are general terms designed to safeguard both the band and the hirer

‘Hirer’ = Person or persons representing the venue. Responsible for booking the band and/or payment. ‘

‘Band’ = Funkline, members of the band and/or a representative thereof.

Engagement = The time, date and place that the band will perform

It is understood that the fee, date and time of the engagement has been agreed in advance with the band and that the fee, plus VAT if applicable, for the Engagement shall be payable on or before the date of the performance of such engagement.

The Hirer shall not make or permit the making of any audio and/or visual recording or transmission of the musicians’ performance without the prior written consent of the musicians.

This Agreement may not be modified or cancelled except by mutual consent, in writing signed by both parties.

2a

It is required that the stage/performance area is safe and unhindered and that adequate space and power outlets are provided. The stage area and venue must be adequate for the provision of live music.
If the performance area is outside, it must be adequately protected from the weather, including but not restricted to; direct sunlight on electrical equipment, equipment or personnel being exposed to excessive wind, rain or snow. The stage area must be flat, level and stable, adequate for the provision of a live music performance.
A rake (Incline) of no more than 1:20 (5 degrees) is acceptable.
If the stage area that does not meet these requirements (e.g. it is unstable, uneven, on a steep incline or is exposed to adverse weather conditions) then the band will reserve the right not to perform until or unless the stage can be fixed, or an alternative stage can be found.

2b
The Hirer and the Band agree that the equipment and instruments of each musician performing for an engagement are not available for use by any other person, except by specific permission of the musician. The Hirer shall ensure a safe supply of electricity and the security of the musicians and their property at the venue.

It is required that adequate security measures have been considered and if necessary, are in place to ensure the safety of the stage and the band. The hirer will be liable for criminal damage (as defined under the Criminal damage act 1971) for damage to equipment caused by unauthorised persons on the stage or entering the stage area.

It is also required that a room or backstage area be made available so that the band can get change clothes and safely leave their belongings.

If the venue/hirer does not provide the requirements on this contract, or if changes to the performance date and/or payment are made without the band’s consent, then the fee must still be paid in full.

4.

If the band cannot attend the performance date (Under clauses 7 & 8) then no payment will be made by the venue to the band or by the band to the venue (Unless a prior arrangement has been made for this circumstance)

It is recommended that the hirer has event insurance in case of unforeseen circumstances which could lead to the cancellation of the performance.

5.

If the venue cannot provide the requirements on this contract (Under clauses 8 & 9) then no payment will be made by the venue to the band or by the band to the venue (Unless a prior arrangement has been made for this circumstance.)

It is recommended that the hirer has event insurance in case of unforeseen circumstances which could lead to the cancellation of the performance.

6.

Payment of the full amount required on this contract is due on the performance date before the performance starts (Unless otherwise stated in writing.) If the venue is unable to pay the full amount due, then a 14 day grace period may be granted to the venue by the band, At the bands discretion, provided that the band has sufficient cause to believe that the venue contemplated and made arrangement for payment to be made on the agreed date.

7.

Force majeure.

No party shall be liable to perform it’s obligations where such failure is as a result of acts of God (including fire, flood, earthquake, storm, hurricane, or other natural disaster.) Personal accident or injury, illness or death. War, invasion, act of foreign enemies hostilities (Whether war is declared or not) Civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, or road traffic incedent which renders the bands vehicles unroadworthy.

8.

Any party asserting force majuere as an excuse shall have the burden of proving that reasonable steps were taken (under the circumstances) to minimise delay or damages caused by foreseeable events, that all non-excused obligations were fulfilled, and that the other party was timely notified of the likelihood or actual occurrence which would justify such and assertion, so that prudent precautions could be contemplated.

This contract does not automatically cover either party for public liability. For more details, or to request a copy of the relevant public liability insurance certificate or Pat testing certificate, please do not hesitate to contact us.

10.

Cancellation

If the hirer wishes to cancel the performance without citing reasons under clauses 7 & 8 then the agreed fee must still be paid in full on or before the agreed date. The band may offer a new performance date to the hirer at no extra cost. Any new performance date must be agreed between both the band and the hirer.

It is recommended that the hirer has event insurance to cover losses due to unforeseen circumstances.

Pricing information.

The cost of hiring Funkline varies depending on several factors:
The location of the venue,
The type of venue
The time of year of the event,
The day of the week of the event.
Prices for hiring Funkine for you event start at around £750.
This price can increase for: performances on weekends, performances in peak summer season
Performances for Christmas / new year
performances which require extra travel expenses or an overnight stay (Funkline are based in the south of England)

Prices can drop for:
Midweek performances.
Performances between January and March.
Afternoon performances or performances which are local and short in nature.
